Once you have found your perfect home, it is time to find a GOOD solicitor, go off a recommendation or at least check out their latest reviews. The cheapest isn’t always the best and we usually find Local solicitors are better than using someone who isn’t familiar with the area.

If you do not have a solicitor to act on your behalf, please ask and we will be able to recommend a local solicitor who we have worked with previously and highly praise. They also work in the same way we do, you’ll have one point of contact which makes communicating with them much easier.

The buying process ideally should look like below:

  • If you are buying with a mortgage, book a meeting with your mortgage broker/lender to start the mortgage application. Your mortgage lender will normally carry out a valuation to ensure the home you are buying is worth what you are paying and that there aren’t any issues. There are different levels of surveys that the bank will carry out, so you need question which one they’ll be carrying out and check that it is this sufficient for you
  • Initially your solicitor should be examining the draft contract, supporting documents & raising enquiries with the seller’s solicitor. You will be expected to go through the forms the seller has completed and let the solicitor know if you have any queries or concerns. When you hear a solicitor advising that they’re raising enquiries or waiting on replies to enquiries, this means they are asking the other sides solicitors questions in regards to the house E.G. Who supplies the gas and electric?
  • Once the mortgage offer has been issued, this will be sent to your solicitor, who will ensure you have the sufficient deposit in place and check the conditions of the mortgage offer.
  • Property Searches are normally conducted at the stage that you receive your mortgage offer (If purchasing cash then they can request searches from the offset, the sooner they do this, the quicker you will complete). These are done to check the local area for mining, water searches etc.
  • Before exchange of contracts can take place your lender will require you to get buildings insurance for your new home. You are responsible for the property as soon as contracts have been exchanged, so it’s in your interests to protect yourself in case of any eventuality.
  • Signing of contracts will be requested by your solicitors in preparation for the exchange of contracts. You and the seller will agree on a date and time to officially exchange contracts and confirm a completion date. Your solicitor will exchange contracts for you, which is usually done by both solicitors/conveyancers reading out the contracts over the phone (which is recorded) to make sure the contracts are identical, and then immediately sending them to one another in the post.
  • On the completion date, your solicitors will advise as soon as the monies have left their possession and is now with the sellers solicitors. The Estate Agent/seller will receive the call from their solicitor to confirm they can release the keys, only at this stage are they legally allowed to hand the keys over to you.
